در‌خصوص دعوی آقای ع.ح. با وکالت آقایان پ.م. و م.ق. وکلای رسمی دادگستری به‌طرفیت آقای ر.ق. با وکالت بعدی آقای ب.پ. وکیل رسمی دادگستری به‌خواسته الزام خوانده به‌پرداخت مبلغ سیصد و بیست و چهار میلیون و سیصد و شصت و پنج هزار ریال از بابت الباقی ثمن معامله موضوع مبایعه‌نامه شماره 3404566 مورخ 90/12/8 یک واحد آپارتمان مسکونی به مساحت 75 متر مربع جزو پلاک ثبتی 1106 فرعی از 83 اصلی حوزه ثبتی تهرانپارس با احتساب خسارات دادرسی و تأخیر تأدیه و همچنین مطالبه ضرر و زیان بابت عدم اجرای تعهد به اِزای روزانه یک میلیون ریال از تاریخ 91/4/30 لغایت اجرای حکم فعلاً مقوم به یکصد و بیست میلیون ریال، دادگاه از توجه به مفاد دادخواست تقدیمی خواهان، جری تشریفات قانونی، تشکیل جلسه دادرسی، استماع اظهارات و دفاعیات طرفین، ملاحظه اصول و مستندات ابرازی خواهان، نظر به اینکه موضوع معامله پلاک ثبتی مورد ادعای خواهان مورد قبول خوانده بوده است و از ناحیه خوانده دلیلی بر پرداخت و برائت ذمه ارائه نگردید لذا دادگاه دعوی خواهان را در قسمت اول خواسته وارد تشخیص مستنداً به مواد 519 – 515 – 198 قانون آیین دادرسی مدنی حکم به محکومیت خوانده به‌پرداخت مبلغ سیصد و بیست و چهار میلیون و سیصد و شصت و پنج هزار ریال از بابت اصل خواسته و پرداخت خسارات دادرسی و حق‌الوکاله طبق تعرفه و پرداخت خسارت تأخیر تأدیه از تاریخ تقدیم دادخواست لغایت زمان اجرا بر مبنای شاخص تورم اعلامی بانک مرکزی که از طریق اجرای احکام محاسبه خواهد شد در حق خواهان صادر و اعلام می‌دارد و در‌خصوص قسمت دوم خواسته، نظر به دفاعیات موجه خوانده و با توجه به پاسخ استعلام حاصله از دفتر اسناد رسمی شماره 165 حوزه ثبتی تهران و نظر به اینکه گواهی عدم حضور صادره از آن دفترخانه مؤثر تلقی نمی‌گردد لذا خواهان استحقاق دریافت ضرر و زیان از بابت عدم اجرای تعهد موضوع مبایعه‌نامه را ندارند دعوی خواهان در این قسمت غیروارد تشخیص مستنداً به ماده 197 قانون آیین دادرسی مدنی حکم بر بی‌حقی خواهان در مطالبه وجه التزام قراردادی صادر و اعلام می‌گردد. رأی صادره حضوری ظرف مدت بیست روز پس از ابلاغ قابل اعتراض در محاکم محترم تجدیدنظر استان تهران می‌باشد.
